Bill Summary

Under this bill, no state agency or other body in state government, political subdivision of the state, or county sheriff may use or permit the federal government to use a facility owned or operated by the state agency, political subdivision, or county sheriff to detain or hold in custody an individual if the individual is being detained or held in custody solely on the basis of the individual[s immigration status. The bill additionally provides that no state agency, political subdivision, or county sheriff may expend moneys to establish or operate, or to assist in the establishment or operation of, an immigrant detention facility in Wisconsin.

AI Summary

This bill prohibits state agencies, political subdivisions (defined as cities, villages, towns, or counties), and county sheriffs from using their facilities to detain individuals solely based on their immigration status or allowing federal agencies to use their facilities for such purposes. The bill specifically bars the use of any carceral facility (such as jails or detention centers) for immigration-related detention. Additionally, the legislation prevents these state and local entities from spending money to establish, operate, or assist in the establishment or operation of immigrant detention facilities within Wisconsin. By creating section 20.935 in the state statutes, the bill aims to limit state and local cooperation with federal immigration enforcement efforts that involve detaining individuals based exclusively on their immigration status, thereby providing a form of sanctuary or protection for immigrants within the state's jurisdiction.
