This bill introduces a new requirement for any person or entity planning to use 30 megawatts (MW) or more of electricity to obtain a Certificate to Operate (COP) from the Delaware Public Service Commission. The bill outlines a comprehensive application process that requires detailed information about the proposed electricity use, including its impact on transmission capacity, infrastructure upgrades, electricity sourcing, and grid reliability. The Commission is granted significant authority to evaluate these applications, considering factors such as PJM Interconnection's (a regional transmission organization) approval, the plan's impact on electric supply services, economic implications, greenhouse gas emissions, renewable energy goals, and public safety. The bill allows for intervention by the State Energy Office and local governments with land use jurisdiction. The Commission can suspend or revoke a COP for material non-compliance or operational safety issues, and must submit an annual report on COP applications. The new requirements apply to all development plans that have not yet received final local approval, and the Commission is empowered to create regulations to implement these provisions. Notably, public utilities operating within their existing service territories are exempt from these requirements.
