This bill, amending the Michigan penal code, creates new penalties for providing false or misleading information related to assisted reproduction, which is defined as any method of causing pregnancy other than sexual intercourse. Specifically, it makes it a felony, punishable by up to five years in prison or a $50,000 fine, for anyone to knowingly provide false information about the human embryo or gamete (sperm or egg) used, the identity of a donor (including their name, birth date, or address at the time of donation), or a donor's medical history, social history, known genetic defects, family medical history, or education level. Furthermore, it establishes a more severe felony, punishable by up to 15 years in prison or a $100,000 fine, for a health professional (an individual licensed or authorized to practice a health profession) who knowingly or recklessly uses or provides a human embryo or gamete for assisted reproduction other than the specific one the patient explicitly consented to in writing; the use of an anonymous donor, whose identity is not revealed to the patient, is not a defense for a health professional violating this section.
