This bill amends the Michigan Estates and Protected Individuals Code to enhance protections for individuals under conservatorship when their real property is being sold or encumbered. The bill requires that before a conservator can sell, mortgage, or place a lien on a protected individual's principal dwelling or real property, they must obtain court approval. To obtain this approval, the conservator must provide an appraisal of the property conducted within the past six months by a licensed professional, and the court must determine that the proposed transaction is in the best interest of the protected individual. Additionally, if the court approves a sale of the principal dwelling for less than its appraised value, the court must explicitly explain on the record why such a sale is in the protected individual's best interest. This new requirement aims to provide greater transparency and protection for vulnerable individuals by ensuring that any significant real estate transactions involving their property are carefully scrutinized and justified to protect their financial interests.
