Bill Summary
Under this bill, the commercial building code rules promulgated by the Department of Safety and Professional Services and in effect on August 1, 2025, apply to a public building, public structure, or place of employment if the plans for the public building, public structure, or place of employment are submitted for examination for compliance with the commercial building code no later than April 1, 2026. Before September 1, 2025, DSPS[s commercial building code rules incorporated by reference the 2015 International Building Code; however, effective September 1, 2025, the commercial building code rules incorporate by reference the 2021 International Building Code. Because this bill may increase or decrease, directly or indirectly, the cost of the development, construction, financing, purchasing, sale, ownership, or availability of housing in this state, the Department of Administration, as required by law, will prepare a report to be printed as an appendix to this bill. For further information see the state and local fiscal estimate, which will be printed as an appendix to this bill.
AI Summary
This bill updates the applicability of commercial building code rules in Wisconsin by specifying that the Department of Safety and Professional Services (DSPS) commercial building code rules in effect on August 1, 2025, will apply to public buildings, structures, and places of employment if their plans are submitted for code compliance examination by April 1, 2026. The bill reflects a transition from the 2015 International Building Code to the 2021 International Building Code, which becomes effective September 1, 2025. Specifically, the legislation creates a new provision (101.02 (26)) that allows buildings to use the code in effect on August 1, 2025, even if they are submitted slightly after the new code's implementation, providing flexibility for construction projects in progress. The bill also notes that a separate report will be prepared by the Department of Administration to assess potential impacts on housing development, construction costs, and availability, which demonstrates an effort to understand the potential economic consequences of this building code update.
