Bill Summary

AN ACT IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To amend, on an emergency basis, section 1507 of the Criminal Justice Coordinating Council for the District of Columbia Establishment Act of 2001 to change the date by which the Prearrest Diversion Task Force shall issue initial recommendations for prearrest diversion of certain misdemeanor offenses and categories of persons to July 2026; and to amend Title 20 of the District of Columbia Official Code to allow for notice of request for formal probate, notice from a foreign personal representative of a decedent who owned any property located in the District of Columbia, and notice of appointment to interested persons, creditors and unknown heirs in a legal periodical or newspaper of general circulation in the District.

AI Summary

This bill makes two primary amendments: first, it modifies the timeline for the Prearrest Diversion Task Force's recommendations by extending the deadline for initial recommendations to no later than June 2025 and the full recommendations to no later than July 31, 2026. The task force is part of the Criminal Justice Coordinating Council and is working on strategies for diverting certain misdemeanor offenses from traditional criminal processing. Second, the bill updates several sections of the District of Columbia's probate code to allow notices related to probate proceedings (such as requests for formal probate, notices from foreign personal representatives, and appointments) to be published in either a legal periodical or a newspaper of general circulation in the District, which expands the previous requirement that limited notices to legal periodicals. The act is an emergency measure, meaning it will take effect upon mayoral approval and remain in effect for up to 90 days, which allows the District to quickly implement these changes while potentially developing more permanent legislation.
