Bill Summary

This bill exempts from the sales and use tax memberships sold to licensed real estate brokers who, pursuant to the membership agreement, offer to compensate or cooperate with other real estate brokers in brokering sales of properties. Under current law, a sales and use tax exemption exists for memberships sold to licensed real estate brokers who, pursuant to the membership agreement, offer to compensate and cooperate with other real estate brokers in brokering sales of properties. Because this bill relates to an exemption from state or local taxes, it may be referred to the Joint Survey Committee on Tax Exemptions for a report to be printed as an appendix to the bill. For further information see the state and local fiscal estimate, which will be printed as an appendix to this bill.

AI Summary

This bill modifies the existing Wisconsin sales tax exemption for memberships sold to licensed real estate brokers by changing the language around compensation and cooperation requirements. Currently, the law requires real estate brokers to both compensate and cooperate with other brokers to qualify for the sales tax exemption. The bill revises this requirement to allow brokers to either compensate or cooperate with other brokers (or both) to be eligible for the tax exemption. The bill also removes specific references to "compensation offers" and "information about compensation" from the existing statute. The change essentially broadens the conditions under which a real estate broker can obtain a tax-exempt membership, making the qualification criteria more flexible. The bill will take effect on the first day of the third month following its publication, providing a clear timeline for implementation of the new tax exemption provisions.
