This bill establishes regulations for how businesses and organizations (called "relying parties") can interact with mobile driver's licenses and mobile identification cards in Michigan. The bill defines key terms such as "mobile enhanced driver license" and "relying party" and sets specific requirements for how these digital licenses can be used during transactions. When a relying party is presented with a mobile license, they must only request necessary data elements, inform the license holder about how their data will be used, obtain the holder's consent before retaining any data, cryptographically authenticate the digital license, and adhere to all applicable privacy laws. The bill also prohibits relying parties from asking license holders to surrender their mobile device, search the device, or mandate the use of a mobile license for completing a transaction. Additionally, the bill clarifies that presenting a mobile license does not grant permission for a relying party to access other data or applications on the mobile device. The bill will only take effect if three related bills (identified by request numbers S04150'25, S04151'25, and S04152'25) are also enacted into law.
