This bill modifies regulations for child care centers located in multiple occupancy buildings, which are buildings housing more than one business or organization. It requires these centers to notify the state department by September 21, 2022, about any changes in other occupants or their uses within the building since their license was issued. For new applications or renewals, centers must disclose the nature of other occupants and their uses. Before issuing or renewing a license, the department will inspect the facility to ensure reasonable safety measures are in place, and may require the center to be self-contained with its own bathrooms, secured against unauthorized entry, separated from hazardous operations, and to have protocols for shared outdoor spaces and alcohol consumption within the building. The bill also clarifies that the child care center's operating hours do not dictate the hours of other occupants and explicitly states that the department cannot regulate other occupants or parts of the building not used by the child care center. Finally, it rescinds a specific administrative rule (R 400.8560) related to child care centers.
