This bill amends the Michigan penal code to create enhanced penalties specifically for cargo theft. Under the new law, an individual convicted of stealing cargo could face an additional prison term of up to 10 years on top of their existing sentence. To pursue these enhanced penalties, the prosecuting attorney must explicitly state on the complaint and information that the defendant is subject to the enhanced sentence. The additional prison term must be served consecutively with any other sentences arising from the same criminal transaction. The bill carefully defines "cargo" as commercial freight moving through various transportation systems like pipelines, railroads, trucks, vessels, and aircraft, specifically excluding direct-to-consumer goods. "Moving in commerce" is defined as the entire journey from origin to final destination, regardless of temporary stops. The enhanced penalty is designed to provide stronger legal deterrence against cargo theft, which can cause significant economic disruption and financial losses to businesses and transportation industries. The law will take effect 90 days after its enactment.
