This bill modifies the Workers' Compensation Act to remove time-based restrictions on medical treatment for employees who are injured at work. Specifically, the bill eliminates the previous 90-day limitation that restricted employees to using only employer-designated healthcare providers. Under the new provisions, employees will still be required to initially visit one of the employer's designated healthcare providers (with at least six providers on the list, including at least three physicians), but there is no longer a strict 90-day period during which they must continue to use only those providers. The bill also maintains protections for employees, such as the right to seek a second opinion if invasive surgery is recommended and the ability to choose which treatment course to follow. Additionally, the bill requires employers to provide clear written notification of employee rights and ensure the employee understands these rights, with failure to do so relieving the employee of notification requirements. The changes will apply to workplace injury claims with a date of injury on or after the bill's effective date, which is 120 days after enactment. The bill aims to provide more flexibility for employees in choosing medical treatment while maintaining a structured approach to workers' compensation healthcare.
