This bill, by adding section 89a to Michigan's penal code, establishes severe penalties for individuals who deliver certain controlled substances that result in serious injury to another person. Specifically, if a person delivers a Schedule 1 or 2 controlled substance, excluding marijuana, in violation of section 7401 of the public health code, and that substance is consumed and causes "serious injury" to anyone, the offender is guilty of a felony punishable by life imprisonment or any term of years. "Serious injury" is defined as permanent, serious disfigurement, serious impairment of health, or serious impairment of a body function, with "serious impairment of a body function" further detailed to include specific examples like the loss of a limb or its use, loss of an eye or ear or their use, substantial impairment of a bodily function, serious visible disfigurement, prolonged comatose states, measurable brain or mental impairment, skull fractures, subdural hemorrhages, and loss of an organ. This legislation aims to hold drug distributors accountable for the severe harm their substances can inflict.
