This bill modifies existing law regarding environmental repair fees collected by municipal solid waste facilities. Specifically, it renumbers a section of the statutes and creates a new provision allowing the owner or operator of a municipal solid waste facility to keep a portion of the collected environmental repair fees. This retention is permitted if the facility has received a loan from the clean water fund program for wastewater treatment infrastructure, and the amount they can retain is equal to the total principal and interest owed on that loan while it is being repaid. The environmental repair fee is a charge collected from those who generate or arrange for the disposal of solid or hazardous waste, which is then typically paid to the state department overseeing waste management.
