This bill amends the Stille-DeRossett-Hale single state construction code act to modify rules about building permit eligibility for cities with administrative hearing bureaus. Specifically, the bill allows cities to create ordinances preventing individuals or property owners from obtaining building permits, certificates of use and occupancy, or variances if they have unpaid civil fines or justice system assessments. However, the bill provides several important exceptions to this rule, including for new property owners who acquired the property through foreclosure or deed in lieu of foreclosure, such as government-sponsored enterprises, financial institutions, mortgage servicers, and credit union service organizations. The bill also clarifies that the permit restrictions do not apply if the requested permit work would address the underlying blight violation that caused the delinquent payment. Additionally, the bill updates the definition of "financial institution" by removing a reference to the Michigan Strategic Fund Act and replacing it with a more comprehensive definition that includes state and national banks, savings institutions, and credit unions. The bill is tie-barred with Senate Bill 631, meaning it will only take effect if that companion bill is also enacted into law.
