This bill aims to shield certain nonprofit organizations that contract with the Tennessee Department of Children's Services to provide community-based care or child welfare services from liability for damages caused by their employees, volunteers, or caregivers, provided these organizations meet specific requirements. These requirements include conducting timely criminal background checks, verifying individuals are not on registries of abusers of vulnerable persons, reporting any known misconduct, taking appropriate personnel actions in response to performance issues, and ensuring staff complete training on child sexual abuse prevention and reporting child abuse and neglect. However, an organization can still be held liable if a claimant proves the organization was not substantially compliant with these requirements, the requirement was meant to prevent the specific harm that occurred, and the non-compliance contributed to that harm. This protection does not apply to damages resulting from the organization's gross negligence, nor does it limit other authorized claims or the ability of government entities to take administrative or regulatory actions.
