NY A09220Establishes the crime of aggravated harassment of a rent regulated tenant which occurs when an owner intentionally engages in a systematic ongoing course of conduct to induce three or more rent regulated tenants occupying different housing accommodations in two or more residential buildings to vacate such housing accommodations or if such owner commits the crime of harassment of a rent regulated tenant and was previously convicted of the same crime in the past five years.

AN ACT to amend the penal law, in relation to the aggravated harassment of a rent regulated tenant

This bill establishes a new crime called "aggravated harassment of a rent regulated tenant," which applies to building owners who intentionally and systematically try to force three or more tenants in rent-regulated apartments across two or more buildings to move out, by making their homes unlivable, endangering their health or safety, or significantly disturbing their peace and quiet, including by cutting off essential services. Alternatively, an owner can be guilty of this crime if they commit the existing crime of harassment of a rent regulated tenant and have been convicted of it in the past five years. The bill also clarifies that a "residential building" for the purposes of this law is a structure with multiple housing units, at least one of which is subject to rent regulation laws, and that a good-faith eviction lawsuit will not by itself be considered harassment.
