This bill seeks to modify the National Labor Relations Board's (NLRB) jurisdiction over labor disputes by significantly increasing the dollar thresholds that determine which employers are subject to NLRB oversight. Specifically, the bill requires the NLRB to update its jurisdictional thresholds by multiplying the existing dollar amounts by ten for the year 2026, and then annually adjusting those thresholds based on the Personal Consumption Expenditure Per Capita Index (a measure of consumer spending published by the Bureau of Economic Analysis). For each subsequent year after 2026, the threshold will be calculated by comparing the index from the previous year to the 2026 baseline. The Bureau of Economic Analysis will be responsible for calculating and publishing this index annually starting in 2027. These changes will apply to any NLRB decisions about jurisdictional disputes made on or after January 1, 2026, effectively making it harder for the NLRB to assert jurisdiction over smaller businesses by dramatically raising the monetary standards that trigger board involvement in labor disputes.
