Currently, when the PSC discusses confidential information related to specific statutory sections (such as those covering telecommunications, utilities, and water/wastewater services), those portions of the hearing are exempt from public meeting requirements. The bill eliminates language that would have automatically terminated this exemption on October 2, 2026, through the Open Government Sunset Review Act. The exemption will remain in place, ensuring that these sensitive discussions can continue to be held in closed sessions, with the requirement that such portions must still be recorded and transcribed. The recordings and transcripts remain confidential, though a court can review them to determine if the exemption was properly applied. By removing the sunset provision, the bill maintains the existing protections for confidential business information discussed during PSC hearings.
