This bill establishes the "New Jersey Veterans and Military Spouses Asset Protection Act" to provide comprehensive financial protections for veterans, active duty service members, and their spouses. The legislation creates significant asset protections by exempting primary and secondary residences from creditor claims without value limitations, provided the properties are properly recorded, and extends this protection to jointly owned properties and surviving spouses. Additionally, the bill safeguards retirement accounts, pensions, disability benefits, and veterans' benefits from creditor claims, and protects motor vehicles owned by veterans, service members, and military spouses up to a fair market value of $30,000 for one vehicle per household. The exemptions do not apply to voluntary liens, government-related obligations, or judgments arising from willful misconduct, fraud, or criminal activity. The bill acknowledges the extraordinary sacrifices made by military personnel and aims to provide financial stability by preventing home loss and protecting critical assets. The protections are designed to be in addition to existing federal protections, such as the Servicemembers Civil Relief Act, and will take effect retroactively to January 1, 2025, applying only to debts incurred or claims filed on or after that date, while preserving the validity of any final judgments entered prior to the effective date.
