Bill Summary

This bill amends the "Municipal Land Use Law," (MLUL) P.L.1975, c.291 (C.50:55D-1 et seq.) to require a developer to submit, as part of the developer's application for a planned development site plan approval, a stormwater impact study of the development conducted by a third-party consultant, who is to be agreed upon by the developer and planning board. The stormwater impact study is to include, but not be limited to, an evaluation of: (1) pre- and post- development stormwater runoff; (2) downstream flood risks; and (3) stormwater mitigation strategies. The MLUL defines a "planned development" as a planned unit development, planned unit residential development, contiguous cluster or noncontiguous cluster, planned commercial development, or planned industrial development.

AI Summary

This bill amends the Municipal Land Use Law (MLUL) to require developers seeking site plan approval for planned developments to submit a comprehensive stormwater impact study as part of their application. The study must be conducted by a third-party consultant mutually agreed upon by the developer and planning board, and must evaluate three key aspects: (1) stormwater runoff conditions before and after development, (2) potential downstream flood risks, and (3) strategies for mitigating stormwater impacts. This requirement applies to various types of planned developments, including planned unit residential and commercial developments, and is designed to ensure more thorough environmental assessment and flood risk management during the site planning process. The bill will help local authorities make more informed decisions about development projects by requiring detailed analysis of how new construction might affect water drainage and potential flooding in the surrounding area, ultimately promoting more responsible land use and environmental protection.
