This bill amends the Michigan Strategic Fund Act to ensure compliance with the Uyghur Forced Labor Prevention Act (UFLPA), a federal law (Public Law 117-78) aimed at preventing the importation of goods made with forced labor from the Xinjiang region of China. Specifically, the bill adds a new section that prohibits the Michigan Strategic Fund (the "fund") from providing any grants, loans, or other economic assistance to entities listed on the "UFLPA entity list," which is a consolidated register of entities identified under the UFLPA. Furthermore, any new or amended written agreements entered into by the fund must include a clause stating that if the recipient is added to the UFLPA entity list, they will forfeit future payments, must repay all previously received payments plus a 10% penalty, and the agreement will then be terminated. Existing agreements must also be amended within 90 days to include these provisions, and if they are not, those agreements will be considered void and unenforceable, and the fund will not be allowed to disburse any further money under them.
