This bill creates the Racing Facility and Racetrack Nuisance Immunity Act, which provides legal protection for racing facilities against nuisance lawsuits under specific circumstances. The bill defines a "racing facility" as a designated area for competitive vehicle and motorsport races, including the track, spectator areas, garages, and associated grounds and buildings. Specifically, property owners within a three-mile radius of a racing facility cannot bring a nuisance lawsuit if the facility was developed with all required permits and established vested property rights before the nearby property was purchased or developed. However, this legal protection does not apply if the racing facility fails to operate in substantial compliance with federal, state, and local laws and regulations. The bill is set to become effective on November 1, 2026, and aims to provide legal certainty and protection for motorsport racing venues against potential nuisance claims from neighboring property owners who may be impacted by noise, traffic, or other typical racing facility activities.
