This bill repeals existing provisions that prohibited food vendors from using expanded polystyrene (EPS) food service containers, effectively removing restrictions on single-use EPS containers like foam plates, cups, and takeout boxes. Specifically, the bill eliminates definitions related to EPS food service containers and prepared food, removes a section of code that previously imposed civil penalties for using such containers, and deletes a requirement for public information campaigns discouraging EPS product use. The bill also modifies the Litter Control and Recycling Fund by removing the allocation of funds for EPS-related public information campaigns, which previously allowed up to 5% of fund moneys to be used for promoting alternatives to expanded polystyrene products. By repealing these provisions, the bill allows restaurants, food vendors, and other establishments to once again use expanded polystyrene food service containers without legal restriction, reversing previous environmental regulations aimed at reducing EPS waste.
