This bill amends Florida Statute 893.145 to revise the definition of "drug paraphernalia" by excluding certain testing products used solely to detect the presence of fentanyl or xylazine, which are dangerous substances. Specifically, it removes language that previously included testing equipment for any controlled substance and inserts language that carves out an exception for products used to identify fentanyl or fentanyl analogues as described in a specific statute, or xylazine. This exclusion, however, does not apply to testing products that can also measure the quantity or potency of a controlled substance. The bill also specifies an effective date of July 1, 2026.
