This bill modernizes Chapter 40R of Massachusetts law by updating zoning incentive and bonus payment schedules for cities and towns that create smart growth or starter home zoning districts. The bill establishes a graduated payment schedule for zoning incentive payments based on the projected number of new housing units, ranging from $20,000 for up to 20 units to $1,200,000 for 501 or more units. Additionally, the bill introduces a density bonus payment of $6,000 per new housing unit in smart growth zoning districts and a production bonus payment of $6,000 per new housing unit in starter home zoning districts. The payments will be made from state trust funds or other authorized appropriations upon confirmation of district approval and issuance of building permits. The bill also requires the department to conduct a review that includes an analysis of incentive payments to ensure they remain consistent with housing costs as measured by the Consumer Price Index. These changes will take effect for tax years beginning on or after January 1, 2026, and are designed to encourage the development of affordable housing in Massachusetts municipalities.
