This bill, called the End Rent Fixing Act of 2025, aims to prohibit rental property owners from engaging in practices that manipulate or coordinate rental prices. Specifically, the bill makes it illegal for rental property owners to use "coordinators" - entities or services that collect rental pricing data, analyze that data using algorithms, or recommend rental prices to multiple property owners. The bill defines a "residential dwelling unit" broadly to include houses, apartments, and manufactured homes, and applies to any person or organization involved in rental property. Violations of the act would be considered an unfair method of competition under the Federal Trade Commission Act and a per se violation of the Sherman Act. The Federal Trade Commission, the Attorney General, and state attorneys general are empowered to enforce the law, and individuals who are harmed by violations can bring civil actions to recover threefold damages and legal costs. The bill does not override existing antitrust laws and allows for stronger state-level protections. If any part of the act is found unconstitutional, the remaining provisions would still remain in effect. The primary goal is to prevent rental property owners from colluding to artificially control or fix rental prices across different properties.
