This bill, known as the Fairness and Access for Immigrant Rights (FAIR) Act, aims to provide immigrant detainees in detention centers with improved access to congressional constituent services. The bill requires detention centers to provide detainees with the ICE National Detainee Handbook in their spoken language within 24 hours of arrival, including information about how to access congressional services. Detainees will be able to request a privacy waiver (ICE Form 60-001) and a Congressional Privacy Release Form, which will allow them to communicate with their congressional representative or a third-party assisting with their case. Detention centers must facilitate this communication by providing access to computers, email, printing, copying, and writing materials. If a detention center fails to provide these services within 30 days, detainees or third-party individuals can submit a complaint or file a civil action. The bill also mandates that an interpreter be provided if forms are not available in the detainee's language. The Department of Homeland Security must implement these rules within 180 days and notify all immigration detention centers within 270 days of the act's enactment, with the provisions taking effect 90 days after enactment.
