This bill requires public elementary and secondary schools, as well as higher education institutions that receive federal funding, to treat discrimination motivated by antisemitism with the same level of seriousness as discrimination motivated by race. The bill provides a detailed definition of antisemitism that includes specific examples, such as calling for harm to Jews, making dehumanizing allegations about Jewish people, accusing Jews of conspiracies or disloyalty, denying or minimizing the Holocaust, and applying unique standards to Israel. The legislation explicitly protects First Amendment rights and does not override state antidiscrimination laws. Importantly, the bill clarifies that criticism of Israel that is similar to criticism of other countries does not constitute antisemitism. To be eligible for federal funding, educational institutions must implement policies that address and prevent antisemitic discrimination by students, employees, or through institutional policies. The definitions of "elementary school," "secondary school," and "institution of higher education" are derived from the Elementary and Secondary Education Act of 1965.
