This bill mandates that certain commercial drivers and drayage truck operators be provided with restroom access under specific circumstances. A "covered driver" is defined as a commercial driver, and a "covered establishment" includes businesses open to the public or entities involved in shipping or receiving goods via commercial motor vehicles, with exceptions for very small establishments with employee-only restrooms. These covered drivers must be granted access to "covered restroom facilities" – restrooms on the premises intended for customers or employees, provided access doesn't pose obvious health, safety, or security risks. Additionally, "covered drayage truck operators," defined as drivers of heavy vehicles operating at ports or intermodal rail yards for cargo transport, are to be provided with "covered restrooms" by "terminal operators" (businesses running marine terminals). This provision includes granting access to existing restrooms if safe, providing additional restrooms if needed, and ensuring parking is available for restroom access, without requiring physical alterations to existing facilities.
