This bill amends the Higher Education Act of 1965 to establish new rules for distance education programs offered by foreign institutions of higher education. Specifically, the bill allows foreign institutions to offer programs partially through distance education if certain conditions are met: no more than 12.5 percent of the program can consist of courses primarily delivered through distance education, the institution must be evaluated and deemed capable of effectively delivering distance education by an outside oversight entity like an accrediting agency or government entity, and students receiving federal financial aid must be physically present in the country where the foreign institution is located during distance education instruction. The bill also clarifies that courses requiring more than 50 percent in-person attendance, even if they include some distance education components, will not be counted as distance education courses. The amendments will take effect on the date of enactment and apply to the first semester beginning at least three months after that date, providing foreign educational institutions with a clear pathway to offer limited distance education programs while maintaining educational quality and ensuring student presence in the institution's home country.
