This bill establishes clear guidelines for snow and ice removal responsibilities in residential lease agreements in New Hampshire. Specifically, the bill requires that any responsibility for snow and ice removal must be explicitly stated in the written lease. By default, if not otherwise specified, the property owner or landlord is responsible for maintaining safe access and clearing snow and ice from common areas such as driveways, walkways, and entryways used by multiple tenants. The bill allows landlords and tenants to mutually agree in writing that the tenant will perform snow and ice removal for specific areas, but such an agreement must be express, voluntary, and included in the lease. The bill does not override local ordinances regarding public sidewalks or rights of way, ensuring that existing municipal regulations remain in effect. The new regulations will apply to all residential leases entered into or renewed on or after January 1, 2027, giving landlords and tenants ample time to adjust their lease agreements to comply with the new requirements.
