This bill, titled "Sexually explicit materials in libraries-requirements," mandates that county and school libraries in Wyoming must ensure that no sexually explicit materials, defined as depictions or descriptions of specific sexual acts, are accessible in sections primarily intended for individuals under eighteen years old. These materials must instead be located in sections aimed at those eighteen and older. The bill requires county library boards and school district boards to establish a formal process for residents to challenge the presence of sexually explicit materials, including providing a specific form and making it available both physically and online, with a decision on challenges due within sixty days. Failure to implement this challenge process by August 1, 2026, will result in a daily civil penalty of $500. Furthermore, any resident can file a lawsuit against a library or school district for violating these provisions, but only after completing the challenge process, and lawsuits will be dismissed if the material is removed or relocated after a challenge is filed; prevailing parties in such lawsuits may be awarded attorney fees and costs.
