This bill establishes "Conrad's Law", which requires the Department of Elementary and Secondary Education to create new regulations for licensed child care facilities focused on safe sleep and care for children, particularly those with special needs. Specifically, the bill mandates that child care facilities develop training and rules for nonrestrained safe sleep policies for children over one year old and children with special needs, including guidelines for weighted blankets (which cannot exceed five pounds or be used on children under one year old). The law requires facilities to provide safe rest options for non-napping children and create individualized care plans for children with special needs. These care plans must be collaboratively developed and annually reviewed by parents/guardians, facility owners/directors, primary care providers, and directly responsible staff members. Additionally, staff members caring for children with special needs must receive specific training about those needs, which can count toward their required annual training hours. The bill explicitly notes that these provisions do not apply to children under one year of age, who are instead governed by a separate existing safe sleep policy regulation.
