This bill, effective after December 31, 2026, prohibits the sale or offering for sale of cosmetics in Arizona if animal testing was used during their development or manufacture, defining "cosmetic" as a product intended for cleansing, beautifying, or altering appearance, but excluding soap, and "cosmetic animal testing" as applying a product to a live animal to evaluate safety. The prohibition applies to testing conducted by the manufacturer, their suppliers, or anyone contracted by them, with several exceptions, including testing conducted outside the U.S. required by foreign authorities (provided the results aren't used to prove safety in Arizona), testing for products regulated under the federal Food, Drug, and Cosmetic Act, testing for ingredients used in non-cosmetic products under specific conditions, and testing required by federal or state authorities under strict circumstances where no non-animal alternatives exist and there's a serious human health risk. The bill also exempts cosmetics and their ingredients tested before January 1, 2027, and allows manufacturers to review or retain data from past animal testing, while establishing that this regulation is a statewide concern that preempts local regulations and imposes a civil penalty of up to $1,000 for the first day of violation, plus $500 for each subsequent day.
