This bill modifies Missouri law regarding maintenance orders (spousal support) in divorce proceedings by updating language to be gender-neutral and introducing new provisions about maintenance duration and termination. The bill allows courts to grant maintenance (spousal support) to either spouse if the seeking spouse lacks sufficient property to meet their reasonable needs and cannot support themselves through employment or is caring for a child. When determining maintenance, courts must consider multiple factors including financial resources, earning capacity, marriage duration, age, and physical/emotional condition of both spouses. A significant new provision requires that maintenance orders automatically end when the paying spouse reaches full retirement age, defined as the date they are eligible for or begin receiving full Social Security retirement benefits. The bill also explicitly gives courts the authority to set an end date for maintenance orders and requires the paying spouse to provide six months' notice before retirement. Additionally, the maintenance order must state whether it is modifiable, and if not explicitly nonmodifiable, can be decreased, increased, terminated, extended, or modified based on substantial and continuing changes in circumstances.
