Bill Summary

A BILL IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To amend the Legalization of Marijuana for Medical Treatment Initiative of 1999 to repeal the definition of daycare center, to add child development facility to the list of establishments within 300 feet of which a medical cannabis license holder may not locate, to permit an Advisory Neighborhood Commission to protest the issuance, renewal, or transfer of an internet retailer license, and to improve the Advisory Neighborhood Commission protest process for medical cannabis licenses by permitting the Advisory Neighborhood Commission or any person with standing to protest on the basis of the effect of the applicant on peace, order, and quiet and the inability of existing law or rules to prevent proximity or undue exposure to children.

AI Summary

This bill amends the District of Columbia's medical cannabis regulations to improve the licensing and location restrictions for medical cannabis establishments. Specifically, the bill repeals the definition of a daycare center and adds "child development facility" to the list of establishments near which a medical cannabis license holder cannot locate. The bill expands the criteria for Advisory Neighborhood Commissions (ANCs) to protest the issuance, renewal, or transfer of medical cannabis licenses, now allowing protests based on the establishment's effect on peace, order, and quiet, as well as concerns about proximity or undue exposure to children. The bill also adds new considerations for license protests, including the impact on residential parking, vehicular and pedestrian safety, and allows ANCs or individuals with legal standing to raise these objections. Additionally, the bill permits ANCs to protest internet retailer licenses, which was not previously allowed. These changes aim to provide more local control and community input in the medical cannabis licensing process while maintaining protections for children and residential areas.
