Bill Summary

AN ACT IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To amend, on a temporary basis, the Department of Transportation Establishment Act of 2002 to reduce the fees for participating in the Streatery Program, to establish a start date for enforcement of the Streatery Guidelines or applicable rules, to declare the District’s policy of promoting streateries, to authorize the Public Space Committee to grant waivers of certain program requirements, if such waiver would not create an undue risk, and to require a streatery permit holder that received an exception to apply for a streatery permit renewal through the Public Space Committee every 2 years; and to amend the Bicycle and Pedestrian Safety Amendment Act of 2016 to require that one of the roadways selected to be a designated corridor shall include the 2000-2400 blocks of 18th Street, NW, in Ward 1.

AI Summary

This bill introduces temporary amendments to support the District of Columbia's Streatery Program, which allows restaurants to use public spaces like streets or parking lanes for outdoor dining. The bill reduces the annual public space rental fee for streatery permits to no more than $15 per square foot and delays enforcement of Streatery Guidelines until January 15, 2026. It explicitly declares the District's policy of promoting streateries as a way to create a more vibrant dining scene and support local businesses. The Public Space Committee is now authorized to grant waivers for certain program requirements, such as distance from curb cuts, height of enclosures, and seating capacity, provided these waivers do not create undue risk to pedestrians or roadway users. Additionally, businesses receiving such exceptions must apply for permit renewals through the Public Space Committee every two years. The bill also requires that one designated roadway for bicycle and pedestrian safety improvements include the 2000-2400 blocks of 18th Street, NW in Ward 1, and adds a recommendation process for designating curbside spaces for streateries, parklets, and other public space activations. The amendments are temporary, set to expire 225 days after taking effect.
