AI Summary
This bill aims to enhance consumer protections and regulatory oversight within the insurance industry in Oklahoma. It mandates that personal and commercial property insurers file detailed quarterly reports with the Insurance Commissioner, providing data on policies in force, cancellations, new policies, premiums, claims, and the use of alternative dispute resolution, with penalties for violations. The bill also increases the maximum civil penalties the Insurance Commissioner can impose for violations of insurance laws and administrative penalties for violations related to unfair insurance practices. It clarifies that insurers cannot use traffic records older than three years (or five years for specific serious offenses) to modify rates or refuse/renew motor vehicle policies, and prohibits canceling, increasing rates, or refusing to renew motor vehicle policies based on a policyholder's first claim, with specific exceptions. Furthermore, it modifies requirements for premium discounts related to wind-resistant construction, requiring insurers to consider all building codes as strictly enforced when offering additional coverage for ordinance or law exclusions. The bill establishes a dispute resolution program for insurance claims, making mediation voluntary except under specific circumstances, and requires claims to be processed through the Insurance Department's consumer complaint program before mediation. It also mandates that insurers provide policyholders with a "Homeowner Claims Bill of Rights" within 14 days of a claim, outlining their rights during the claims process, and sets stricter timelines for insurers to acknowledge claims, provide estimates, and accept or deny claims, with penalties for untimely payments and a requirement for written explanations for payment differences. Additionally, it prohibits insurers from canceling or increasing premiums on homeowner policies solely based on a first claim or claims occurring more than five years prior, and restricts the use of weather-related claims history for cancellations or premium increases, while also prohibiting refusal to issue or renew a homeowner's policy based solely on aerial imaging or the age of a roof less than 15 years old, and requires insurers to allow roof inspections and provides a procedure for calculating roof age. Finally, it modifies penalties for violations of the Unfair Claims Settlement Practices Act and clarifies the applicability of the Insurance Commissioner's enforcement powers.
