This bill amends Arizona law regarding property disclosures for land divisions, specifically for sellers of five or fewer parcels in unincorporated areas. It clarifies that a seller, or an escrow agent acting on their behalf, must record an executed disclosure affidavit at the same time the deed is recorded, and that a subsequently recorded affidavit supersedes any previous ones. The bill also expands the types of sellers who are exempt from providing this affidavit, now including personal representatives of estates, in addition to trustees of deeds of trust and officers selling property through execution sales. Furthermore, it adds new disclosure requirements for buyers concerning groundwater transportation rights and clarifies existing disclosures related to wells and wastewater treatment facilities. The bill also specifies that if the seller is a trustee of a subdivision trust, the beneficiary of that trust is responsible for providing the disclosure affidavit.
