This bill establishes new provisions governing the deployment of the Missouri National Guard for active duty combat, specifically limiting the governor's ability to call the Guard into such service. The bill defines "active duty combat" as participation in an armed conflict, performing hazardous service related to an armed conflict in a foreign state, or performing a duty through an instrumentality of war. Under the new provisions, the Missouri National Guard can only be called into active duty combat if the United States Congress has either made an official declaration of war or specifically called forth the Guard to execute United States laws, repel an invasion, or suppress an insurrection, as authorized by the U.S. Constitution. The governor is required to take all necessary actions to comply with these restrictions. However, the bill does not prohibit the governor from deploying the National Guard for defense support for civil authority missions within the United States or in a foreign state. The legislation also preserves the governor's existing authority to call out the organized militia for maintaining law and order, suppressing insurrection, and providing emergency relief during public catastrophes.
