This bill modifies the existing law regarding discounts provided by electrical corporations to certain customers with new or expanding electrical loads. The bill establishes two tiers of discounts: for customers with new loads between 300 kilowatts and 10 megawatts (with a 35% discount for five years), and for customers with new loads between 10 and 75 megawatts (with a 25% discount for five years). To qualify, customers must have a specific load factor, receive an economic development incentive, and meet the electrical corporation's economic development rider criteria. The bill introduces a new term "nonqualifying facility" which excludes certain data center facilities from receiving these discounts. Customers must apply for the discount at least 90 days in advance and will be subject to annual verification of their incremental demand. The bill also specifies that the revenue impact of these discounts will be distributed across all customer classes in future rate proceedings, and customers must maintain their load requirements to continue receiving the discount. Notably, the electrical corporation's authority to offer these discounts will terminate on the same date as its authority to make certain deferrals under a related section of law.
