This bill amends the Clean Air Act to create a new presidential waiver authority for advanced manufacturing facilities and critical mineral facilities regarding air pollution emissions offsets. Specifically, the President can now waive, either partially or fully, emission offset requirements if he determines it is in the national security interests of the United States. The bill defines an advanced manufacturing facility as a semiconductor or semiconductor equipment manufacturing facility, and a critical mineral facility as a facility primarily focused on extracting, processing, refining, or milling critical minerals as designated by the Secretary of the Interior. Additionally, the bill allows state permitting authorities to provide alternative emissions offset methods for these facilities, including allowing facilities to demonstrate they have used all reasonable offset methods, and giving states the option to impose alternative offset measures or charge an emissions fee up to 1.5 times the average cost of local stationary source control measures from the previous three years. The President cannot delegate this waiver determination to any other person, ensuring direct presidential oversight of these national security-related emissions offset decisions.
