This joint resolution amends Utah's Rules of Evidence, specifically Rule 404, which governs the admissibility of evidence related to a person's character or past crimes and other acts. Generally, evidence of a person's character or past actions cannot be used to prove they acted in a similar way on a specific occasion. However, there are exceptions, such as when a defendant in a criminal case offers evidence of their own good character or the victim's bad character, or when the prosecution offers evidence to rebut such claims. The resolution clarifies that evidence of past crimes, wrongs, or other acts can be admitted for specific purposes other than proving character, such as demonstrating motive, intent, or identity, provided the prosecutor gives the defendant reasonable notice of their intent to use such evidence. Crucially, the resolution introduces new provisions allowing for the admission of evidence of similar past acts in child molestation cases and sexual assault cases to prove a defendant's propensity to commit the crime charged, with specific disclosure requirements for the prosecution. These changes are intended to take effect upon a two-thirds vote of each house of the legislature, as per the Utah Constitution.
