This bill establishes a new "Unfair and Deceptive Pricing Act" within Utah law, which will be administered and enforced by the Division of Consumer Protection. The Act defines key terms such as "clearly and conspicuously" (referencing federal regulations), "consumer," "consumer transaction," "final price" (including government and shipping charges), "mandatory ancillary charge" (fees required to purchase a product, with specific exclusions like utilities or finance charges), "pricing information," "product," "shipping charge," "total price," and "utility." It prohibits misrepresenting mandatory ancillary charges and inflating government or shipping charges, and requires that the total price be clearly and conspicuously disclosed when advertising or offering a product, with the final price being more prominent than any other pricing information. The Act includes exemptions for broadband internet providers who comply with federal disclosure requirements, financial institutions governed by the Gramm-Leach-Bliley Act, and entities with express preemption under federal law. The Division of Consumer Protection is empowered to issue administrative fines of up to $2,500 per violation, bring court actions seeking injunctions, disgorgement of funds, and additional fines, and may also impose civil penalties of up to $5,000 for violating administrative or court orders, with all collected funds going to the Consumer Protection Education and Training Fund. This bill is set to take effect on July 1, 2026.
