This bill amends existing bail and recognizance law to establish specific timelines for scheduling hearings on motions to modify or revoke bail, with a particular focus on domestic violence, stalking, and harassment cases. The bill requires that such hearings be scheduled within 72 hours (excluding weekends and holidays) when a motion is filed by either the state or the defense. Before taking action on a motion, the court must receive certified copies of all relevant legal documents, including the complaint, affidavit, warrant, bail slip, and any existing court orders. In cases where a district court has previously determined that a person poses a danger to another, the superior court must conduct a hearing with notifications to both parties, the charging police department, and the victim, and must make written findings supporting any modifications to the original bail conditions. The court must also consider the district court's previous findings and orders when making its determination. The bill is set to take effect on January 1, 2027, providing ample time for courts and legal professionals to prepare for the new scheduling requirements.
