Bill Summary

Landlord nexus. Provides that, after June 30, 2026, a landlord may not lease a property in Indiana unless the landlord: (1) is authorized to do business in Indiana; (2) maintains a residence or an office at one or more physical locations in Indiana; (3) appoints an Indiana licensed real estate broker or broker company to manage the rental property; or (4) owns five or less properties in Indiana. Allows the attorney general to take enforcement action if a landlord improperly leases a property.

AI Summary

This bill, effective July 1, 2026, requires landlords leasing property in Indiana to have a connection, or "nexus," to the state. Specifically, after June 30, 2026, a landlord, defined as someone who leases property but not an individual owner of a single property, must either be authorized to do business in Indiana, maintain a physical residence or office in the state, hire an Indiana-licensed real estate broker or company to manage the rental property, or own five or fewer properties in Indiana. The bill also empowers the Attorney General to take enforcement action against landlords who violate these provisions, including issuing notices to correct violations and, if uncorrected, pursuing civil actions for penalties up to $10,000 per violation, injunctions, and recovery of legal costs.
