Bill Summary

AN ACT Relating to requiring hospitals to offer immunizations for 2 influenza to inpatients 65 years of age or older and inpatients with 3 one or more chronic health conditions; and adding a new section to 4 chapter 70.41 RCW. 5

AI Summary

This bill requires hospitals in Washington State to offer influenza (flu) immunizations to certain inpatients, meaning patients admitted to the hospital for care, between October 1st and March 1st each year, starting July 1, 2027. Specifically, this offer must be made to all inpatients who are 65 years of age or older, and to any inpatient, regardless of age, who has one or more chronic health conditions, unless a doctor determines the flu shot is not medically advisable for them. However, this requirement is contingent on the hospital having the flu vaccine available when the patient is physically present and receiving services, and hospitals are exempt from this mandate during a declared state of emergency or other major disaster that significantly impacts healthcare services. Additionally, critical access hospitals, which are small rural hospitals certified under a specific federal law (42 U.S.C. Sec. 1395i-4), are not required to comply with these new immunization provisions.
