This bill, concerning gender transition procedures and provider liability in Arizona, establishes that a healthcare professional or physician who provides a gender transition procedure to a minor will be held strictly liable for all costs associated with any subsequent detransition procedures the minor seeks within twenty-five years of starting the transition. Minors who undergo detransition can sue these providers for the cost of detransition, other relief, and attorney fees before they turn twenty-six. Furthermore, providers are strictly liable for any physical, psychological, emotional, or physiological harm a minor experiences due to gender transition procedures or their aftereffects, including detransition, within twenty-five years. Individuals who suffer such harm, or their guardians, can sue the provider within eight years of the individual's eighteenth birthday or four years after discovering both the injury and its link to the treatment, whichever is later, seeking damages for pain and suffering, loss of reputation, income, and the expectation of parenthood, as well as punitive damages and attorney fees. Importantly, healthcare professionals and physicians are prohibited from obtaining any contractual waiver of this liability, as such waivers are considered void and against public policy in Arizona.
