This bill establishes a comprehensive national framework to prevent, detect, and respond to educator sexual misconduct through the creation of the National Educator Misconduct and Discipline Registry (NEMDR) and a Federal Task Force. The bill defines "educator" broadly to include anyone with regular student contact and "sexual misconduct" to encompass a wide range of inappropriate behaviors. Schools and districts will be required to report any findings of sexual misconduct, terminations, resignations during investigations, or boundary violations to both state educational agencies and the NEMDR within 48 hours. The registry will serve as a national clearinghouse to prevent educators with substantiated misconduct from being rehired, with access granted to school districts, state agencies, law enforcement, and licensing bodies. A federal task force composed of representatives from education, justice, child protection, and law enforcement will be established to collect and analyze data, identify systemic weaknesses, and provide annual reports to Congress. Schools must query the NEMDR for all hiring decisions involving student contact, and states or districts that fail to comply with reporting requirements may face funding penalties and be required to submit corrective action plans. The reporting and training requirements will take effect 12 months after enactment, with the NEMDR becoming fully operational within 24 months.
