This bill amends Arizona law regarding writs of restitution, which are court orders to return property to a landlord after a tenant has been evicted. Specifically, it changes the penalty for a defendant who, after being lawfully served with a writ of restitution, remains in or returns to the property without permission from the owner or lawful controller. Previously, this was considered criminal trespass in the third degree under section 13-1502, but this bill elevates it to criminal trespass in the first degree under section 13-1504. The bill also mandates that courts inform defendants of this increased penalty when they are found guilty of forcible entry and detainer or forcible detainer, which are legal actions for regaining possession of property.
